INFORMATION FOR BUYERS

1. Introduction.

The information notes below are intended to assist buyers, especially those who are inexperienced or new to our showrooms. All sales are made in accordance with our printed Conditions of Sale, which are available for consultation at any time and normally accompany the catalogues. Our team will be happy to help you if you don't quite understand something.

2. Agency.

As an auctioneer, we often engage the seller as an agent, whose identity is normally withheld for confidentiality reasons. So when you buy, your main contract is with the seller.

3. Estimates.

Estimates are designed to help buyers estimate how much money might be needed to purchase a given lot. The lowest estimate may represent the lowest price and will certainly not be undercut. Estimates do not include buyer's premium or sales tax (if applicable). Estimates are made some time before sale and are subject to change upon notice. They are by no means definitive.

4. Buyer's commission.

Auction conditions oblige the buyer to pay a premium of 30% over the hammer price for each lot auctioned. This prize includes VAT (see below). All online purchases made through site-saleroom.com will incur an additional fee of 5% plus VAT on the auction price.

5. IVA

(†) indicates that VAT is paid by the buyer at the standard rate (currently 20%) on the auction price and is added to the buyer's premium. This VAT charge is likely because the seller is registered for VAT in the European Union and does not operate the Dealer Margin Scheme or because VAT is paid at 20% on importation into the UK. The double symbol (**) indicates that the lot was imported from outside the European Union and the current situation is that these lots are subject to a reduced VAT rate (5%) on the gross price of the lot (i.e. both the auction price and buyer's premium). Lots that appear without any of the above symbols indicate that no VAT will be paid on the auction price. This is because these lots are sold through the Auctioneers' Margin Regime and it should be noted that the VAT included in the prize is not recoverable as input tax.

6. Condition of Lots.

Please read carefully the lot condition notice contained in the sales conditions. Potential buyers have ample opportunity to inspect the lot and neither the seller nor we, as the auctioneer, accept any responsibility for its condition. In the case of mechanical objects of any age, in particular, perfect functioning is not guaranteed. However, under certain circumstances, lots mislabeled as "intentional counterfeits" may be returned for a refund. There is a 2 week limit. (The term "intentional misrepresentation" is defined in our Terms of Sale).

7. Status Reports.

We can help buyers who cannot see it by providing a condition report, but these reports are based on our own opinion only and are for guidance only and no responsibility is assumed for their accuracy. Potential buyers are strongly encouraged to take a look. (See our conditions of sale).

8. Export of Goods.

Buyers wishing to export goods must determine (a) whether an export license is required and (b) whether there is a specific prohibition on importing such goods, e.g. may contain prohibited materials such as ivory. Ask us if you need help.

9. Bidding.

Bidders may be required to register prior to the start of the auction and lots will be billed to the name and address on the registration form. If we don't know you, some form of identification may be required. Find out in advance about our bidding procedures by telephone.

10. Bidding for Commissions.

Commission bids can be left to the auctioneers, stating the highest bid amount, with no buyer premium. They will be carried out in the most economical way possible, taking into account the reservation (if any) and the competing offers. If two buyers submit identical commission bids, the auctioneer may favor the bid received first. Find out in advance by phone or email about our rules on commission offers.

11. Forms of Payment.

Payment methods. Ewbank accepts secure online payments for all items by credit or debit card with 3D Secure. Payment can be made in person by chip and PIN card or in cash (maximum £5,000). Bank transfers are also accepted (buyer is responsible for all international bank transfer fees). Ewbank can no longer accept checks as payment for items purchased at auction. Please speak with our office before selling if you wish to use other payment methods. There are no additional fees for credit or debit card payments (either securely online or in person via a chip and PIN machine).

12. Collection and Storage.

Consider what the terms of sale say about collection and storage. It is important that the goods are paid for and collected promptly. Any delay may result in the buyer paying storage fees, currently set at £5 plus VAT per lot per day.

Any statement of authorship, attribution, provenance, date, age, provenance and status is an expression of opinion and should not be construed as a statement of fact. Auctioneers reserve the right to consult with any expert or authority they deem reliable to form an opinion.

Artist name(s) and surname(s): In our opinion a work by the artist.
Initials of the artist's name and surname: In our opinion, a work from the artist's time, which may be wholly or partially authored by him.
Artist's surname only: In our opinion, a work of the artist's school or student or in his style and of uncertain date.
'English School', 'Italian School': etc: In our opinion, a later work than the style suggests.
"Signed": Has a signature that we believe is trustworthy.
'Dating': He is so old and in our opinion was executed that day.
The term "bears" a signature and/or a date and/or an inscription: means that, in our opinion, the artist's name and/or date and/or inscription were added by someone else.
Measurements: Height precedes width.

Name Surname: In our opinion a work of the artist.

Assigned Name Last Name: In our opinion, a period work that may be the artist's work in whole or in part.

First name Last name Study: In our opinion, a work by an unknown hand that could have been made in the artist's studio.

Name Name Circle: In our opinion a work from the artist's time that shows his influence.

Name Follower Last Name: In our opinion, a work done in the style of the artist, but not necessarily by a student.

Naming Mode Surname: In our opinion a work in the style of the artist, but later.

First Name Last Name: In our opinion, a copy of any date of a work by the artist Signed / Inscribed /

Date Name Surname: In our opinion, the work is signed/inscribed/dated by the artist.

TERMS OF SALE

Ewbank will conduct negotiations with bidders, buyers and anyone present in the auction room prior to or in connection with a sale subject to the following terms and conditions and other terms and notices referenced herein.

1. Definitions in these Terms:

"Auctioneer" means the Ewbank entity or its authorized auctioneer, as applicable;
"Intentional forgery" means an imitation made with the intent to mislead as to authorship, origin, date, age, period, culture or source, but is clearly identified in the catalog as the work of a particular author and at the time of sale had a value substantially less than what it would have been had it lived up to its description;
"Bid Price" means the Bid Level reached (equal to or above a Reserve) when the Auctioneer reduces the Bid;
“Consignment Terms” means the agreed terms and commission rates at which Ewbank accepts instructions from Sellers or their agents;
"Total Amount Due" means the Auction Price in respect of the Lot sold together with any Buyer Premium, applicable VAT and any additional charges payable by a Defaulting Buyer under these Terms;
“Sales Revenue” means the net amount due to Seller, being the Auction Price of the lot sold, less commission at the specified rate, applicable VAT and any other amounts due to us from Seller in any capacity, regardless of source;
"You", "your" etc. refer to the purchaser as identified in Condition 2
When appropriate, the singular includes the plural and vice versa.
2. Bidding Process and the Buyer

Bidders must register their details before bidding and comply with security procedures before entering the auction room to view or bid;
The highest bidder accepted by the selling auctioneer will purchase the auction price and any dispute over a bid will be resolved by rebidding the lot during the auction or otherwise in the sole discretion of the auctioneer. The auctioneer will act reasonably in exercising this discretion.
Bidders are considered customers.
Our right to bid on behalf of the seller is expressly reserved up to the value of a reserve and we also reserve the right to reject any bid.
3. Increased

Bid increments are at the sole discretion of the Auctioneer.

4. The purchase price

The buyer pays the auction price together with a buyer's premium of 30% including VAT [or incrementally] at the rate required by law. In addition to Online Shopper Rewards and any other fees set forth in these Terms.

5. Value Added Tax

VAT on the auction price is charged by law on all items marked with a "†" or double asterisk.
VAT will be charged at the legal rate in force on the date of sale and will be due by the buyers of the respective Lots. (See "Information for Buyers" for a brief explanation of the VAT situation.)

6. Payment

Immediately after selling a ticket, you can:
provide us with proof of identity upon request and
pay us the full amount due in cash or by other means agreed with us.
Any payment you make to us may be set off by us against any amount you owe us on any account, irrespective of your express or implied instructions or your agent.
7. Title and Collection of Purchases

Title to purchased lots will not pass to you until you pay us the full amount due.
You must withdraw, at your own risk, any lots you have purchased and paid for up to 3 business days after the auction date or after clearing any check used for payment, after which you are responsible for all withdrawals. , storage costs and warranty for damages.
No purchase can be claimed or removed until paid.
8. Complaints about non-payment or non-payment of purchases

If a Lot is not paid in full and withdrawn in accordance with these Terms, or if there is any other breach of these Terms, we, as agents for the seller and on our own behalf, in our sole discretion and without prejudice to any other rights we may have , you may be entitled to exercise one or more of the following rights and remedies:

take action against you for damages for breach of contract;
cancel the sale of that lot and/or any other lot that we have sold to you;
resell the Lot (by auction or private contract), in which case you will be responsible for any resulting defect in full (after crediting a partial payment and adding resale costs). The resulting surplus belongs to the seller;
collect, store and insure the goods at your expense and, in the case of storage, at our premises or elsewhere;
Charge interest of a maximum of 1.5% per month on the total amount due if not paid more than 3 business days after the sale;
withhold this or any other ticket sold to you until you have paid the full amount due;
reject or ignore bids made by you or your agent in future auctions, or impose conditions before accepting such bids;
Use the proceeds from the sale of other property owed to you or owed to you in the future to pay the full amount owed and to exercise a lien (which is a right of ownership) on your property in our possession until the debt owed is settled .
As Seller's agent and on our own behalf, we will exercise these rights and remedies only to the extent reasonably necessary to provide equitable relief for a breach of these Terms.
9. Third Party Liability

All members of the public in our facilities are there at their own risk and must respect accommodation design and safety precautions. Consequently, neither the Auctioneer nor our employees or agents will be liable for death or personal injury (except as required by law resulting from our negligence) or similar security of property of any person visiting them prior to or during an Auction.

10. Commission Offers

Although potential buyers are strongly encouraged to attend the auction and are always responsible for any decision to bid on a particular lot and presumably have inspected it carefully and are satisfied with its condition, we will bid if we so clearly state in writing on your name. Neither the auctioneer nor our employees or agents will be liable for any failure unless such failure is unreasonable. If two or more commission offers are published at the same level, we reserve the right, at our sole discretion, to favor the first offer made.

11. Title and Availability Guarantee

Seller warrants to Auctioneer and you that Seller is the true owner of the item being sold or has been duly authorized by the true owner to offer it for sale and may transfer title to the item free of any third party claims. .

12. Agency

The auctioneer normally only acts as an intermediary and disclaims all liability for any default by either the seller or the buyer.

13. Terms of Sale

Seller acknowledges that the Lots will be sold in accordance with the provisions of these Terms in their entirety and the terms of shipment notified to the shipper at the time the Lot was entered.

14. Descriptions and Conditions

While we strive to accurately describe lots, it may not be practical for us to conduct extensive due diligence on each lot. Potential buyers have ample opportunity to preview and inspect any sale prior to any sale and they (and any Independent Experts on their behalf) must ensure the accuracy of any description applied to a lot. Potential buyers also bid with the understanding that any representations or statements made by us as to authorship, authenticity, provenance, date, age, provenance, condition or estimated selling price necessarily involve matters of opinion. We promise that such opinions will be honest and reasonable, and we accept responsibility for opinions expressed negligently or fraudulently. Subject to the foregoing, neither we, the Auctioneer, nor our employees or agents, nor the Seller accept responsibility for the accuracy of such opinions and all conditions and warranties, express or implied, as to the description, condition or quality of the Lots or by law , are excluded. . This condition is subject to the following condition regarding intentional counterfeiting and applies except as provided in paragraph 6 “Information for Purchasers”.
Private contract sales carried out under these conditions are considered auction sales within the meaning of consumer law.
15. Counterfeits

Notwithstanding the above condition, any lot considered to be deliberately counterfeit (as defined) may be returned to us within 21 days of the auction, provided it is in the same condition in which it was purchased and is accompanied by the dates that identify it. the applicable catalog description and a written notice of defects. If the evidence presented convinces us that the lot is a deliberate counterfeit, we will refund the money you paid for the lot, including any buyer's premium, provided that (1) the catalog description is the recognized opinion of Scientists and professionals at the date of sale, or (2) you personally cannot transfer good and marketable property to us, you have no rights under this condition.

The right of return provided for in this condition is in addition to any right or remedy provided by law or these Conditions of Sale.

GENERALLY

We have the right, in our sole discretion, to refuse anyone to enter our premises or participate in our auctions.

All claims for damages, liabilities and costs arising out of any breach of these Terms and the exclusions provided herein shall be due to the Seller and/or the Auctioneer, as the case may be.
Such rights and exclusions are extended and are intended to benefit the employees and agents of the Seller and/or Auctioneer who may exercise them.

All notices to buyers, sellers, bidders or viewers may be sent via first class mail or Swiftmail, in which case they will be deemed received by the recipient 48 hours after posting.

Special terms may be used in catalog descriptions of certain classes of articles, in which case the descriptions are to be interpreted in accordance with a glossary that appears at the beginning of the catalogue.

Any allowance granted by us to any bidder, buyer or seller, notwithstanding the strict terms of these Terms or the Terms of Publication, will only affect the position at the relevant time and only in relation to that particular hammer price; in all other respects, these Terms will be deemed in full force and effect.

Immediately after selling a ticket, you can:
provide us with proof of identity upon request and
pay us the full amount due in cash or by other means agreed with us.
Any payment you make to us may be set off by us against any amount you owe us on any account, irrespective of your express or implied instructions or your agent.
7. Title and Collection of Purchases

Title to purchased lots will not pass to you until you pay us the full amount due.
You must withdraw, at your own risk, any lots you have purchased and paid for up to 3 business days after the auction date or after clearing any check used for payment, after which you are responsible for all withdrawals. , storage costs and warranty for damages.
No purchase can be claimed or removed until paid.
8. Complaints about non-payment or non-payment of purchases

If a Lot is not paid in full and withdrawn in accordance with these Terms, or if there is any other breach of these Terms, we, as agents for the seller and on our own behalf, in our sole discretion and without prejudice to any other rights we may have , you may be entitled to exercise one or more of the following rights and remedies:

take action against you for damages for breach of contract;
cancel the sale of that lot and/or any other lot that we have sold to you;
resell the Lot (by auction or private contract), in which case you will be responsible for any resulting defect in full (after crediting a partial payment and adding resale costs). The resulting surplus belongs to the seller;
collect, store and insure the goods at your expense and, in the case of storage, at our premises or elsewhere;
Charge interest of a maximum of 1.5% per month on the total amount due if not paid more than 3 business days after the sale;
withhold this or any other ticket sold to you until you have paid the full amount due;
reject or ignore bids made by you or your agent in future auctions, or impose conditions before accepting such bids;
Use the proceeds from the sale of other property owed to you or owed to you in the future to pay the full amount owed and to exercise a lien (which is a right of ownership) on your property in our possession until the debt owed is settled .
As Seller's agent and on our own behalf, we will exercise these rights and remedies only to the extent reasonably necessary to provide equitable relief for a breach of these Terms.
9. Third Party Liability

All members of the public in our facilities are there at their own risk and must respect accommodation design and safety precautions. Consequently, neither the Auctioneer nor our employees or agents will be liable for death or personal injury (except as required by law resulting from our negligence) or similar security of property of any person visiting them prior to or during an Auction.

10. Commission Offers

Although potential buyers are strongly encouraged to attend the auction and are always responsible for any decision to bid on a particular lot and presumably have inspected it carefully and are satisfied with its condition, we will bid if we so clearly state in writing on your name. Neither the auctioneer nor our employees or agents will be liable for any failure unless such failure is unreasonable. If two or more commission offers are published at the same level, we reserve the right, at our sole discretion, to favor the first offer made.

11. Title and Availability Guarantee

Seller warrants to Auctioneer and you that Seller is the true owner of the item being sold or has been duly authorized by the true owner to offer it for sale and may transfer title to the item free of any third party claims. .

12. Agency

The auctioneer normally only acts as an intermediary and disclaims all liability for any default by either the seller or the buyer.

13. Terms of Sale

Seller acknowledges that the Lots will be sold in accordance with the provisions of these Terms in their entirety and the terms of shipment notified to the shipper at the time the Lot was entered.

14. Descriptions and Conditions

While we strive to accurately describe lots, it may not be practical for us to conduct extensive due diligence on each lot. Potential buyers have ample opportunity to preview and inspect any sale prior to any sale and they (and any Independent Experts on their behalf) must ensure the accuracy of any description applied to a lot. Potential buyers also bid with the understanding that any representations or statements made by us as to authorship, authenticity, provenance, date, age, provenance, condition or estimated selling price necessarily involve matters of opinion. We promise that such opinions will be honest and reasonable, and we accept responsibility for opinions expressed negligently or fraudulently. Subject to the foregoing, neither we, the Auctioneer, nor our employees or agents, nor the Seller accept responsibility for the accuracy of such opinions and all conditions and warranties, express or implied, as to the description, condition or quality of the Lots or by law , are excluded. . This condition is subject to the following condition regarding intentional counterfeiting and applies except as provided in paragraph 6 “Information for Purchasers”.
Private contract sales carried out under these conditions are considered auction sales within the meaning of consumer law.
15. Counterfeits

Notwithstanding the above condition, any lot considered to be deliberately counterfeit (as defined) may be returned to us within 21 days of the auction, provided it is in the same condition in which it was purchased and is accompanied by the dates that identify it. the applicable catalog description and a written notice of defects. If the evidence presented convinces us that the lot is a deliberate counterfeit, we will refund the money you paid for the lot, including any buyer's premium, provided that (1) the catalog description is the recognized opinion of Scientists and professionals at the date of sale, or (2) you personally cannot transfer good and marketable property to us, you have no rights under this condition.

The right of return provided for in this condition is in addition to any right or remedy provided by law or these Conditions of Sale.

All claims for damages, liabilities and costs arising out of any breach of these Terms and the exclusions provided herein shall be due to the Seller and/or the Auctioneer, as the case may be.
Such rights and exclusions are extended and are intended to benefit the employees and agents of the Seller and/or Auctioneer who may exercise them.

All notices to buyers, sellers, bidders or viewers may be sent via first class mail or Swiftmail, in which case they will be deemed received by the recipient 48 hours after posting.

Special terms may be used in catalog descriptions of certain classes of articles, in which case the descriptions are to be interpreted in accordance with a glossary that appears at the beginning of the catalogue.

Any allowance granted by us to any bidder, buyer or seller, notwithstanding the strict terms of these Terms or the Terms of Publication, will only affect the position at the relevant time and only in relation to that particular hammer price; in all other respects, these Terms will be deemed in full force and effect.
